1. What this service is

BizGen is an operator console that a business owner connects their own accounts to, so they can see and manage their business from one place. By using BizGen, the owner agrees to these terms.

2. The owner is responsible for what gets sent

BizGen can draft emails and other outbound messages, but it never sends anything through a connected account without the owner’s explicit approval first. The owner reviews and approves every outbound email before it goes out, and the owner is responsible for the content they approve.

3. Acceptable use

No spam. Any email sent through a connected account must comply with the CAN-SPAM Act. BizGen builds an unsubscribe link and a postal address footer into outbound emails to help the owner stay compliant, but the owner remains responsible for how they use the product.

The owner will not use BizGen to send content that is illegal or harassing, or that violates the terms of the outside services BizGen connects to, such as Gmail or Stripe.

4. No warranty

BizGen is provided as is, without any warranty of any kind, express or implied. BizGen does not guarantee the service will be uninterrupted, error free, or fit for any particular purpose.

5. Limitation of liability

To the fullest extent permitted by law, BizGen and its founder are not liable for any indirect, incidental, or consequential damages arising from use of the service. BizGen’s total liability for any claim is limited to the amount the owner paid for the service in the twelve months before the claim, or one hundred dollars, whichever is greater.

6. Termination

The owner can stop using BizGen and disconnect their accounts at any time from the Connections page. BizGen may suspend or terminate an account that violates these terms, particularly the acceptable use section above.

7. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.
